1. Introduction

Welcome to JApply (the “Platform”, “Website”, or “Service”), available at https://japply.org. By accessing or using JApply, you confirm having read and that you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Service.

JApply is operated by JApply SAS, a company registered in Ouagadougou, Burkina-Faso (“we”, “us”, “our”). Your contractual relationship is with JApply SAS, which provides access to and operates the Platform on a commercial basis.

However, all intellectual property in the app’s code, designs, diagrams, databases (content + structure), AI, production environments, text, graphics, brand name “JApply”, and related assets is and remains the personal property of LOGOSU–TEKO Ekoue Max Aristide Patrice (“owner”), who licenses their use to JApply SAS for service delivery. In the event JApply SAS ceases operations, this personal intellectual property shall not automatically transfer or be considered an asset of JApply SAS, and remains the exclusive property of its owner.

2. Service Overview

JApply provides online tools to assist users with career preparation, including the generation of CVs, cover letters, and job-application materials using Artificial Intelligence (AI).
The Platform offers both free and paid subscription plans. Users can consult the pricing information displayed on the website, which may be updated from time to time.

3. Acceptance of Terms

By creating an account or using any part of the Platform, you acknowledge that you:

• Have read, understood, and agree to these Terms;
• Are legally capable of entering into a binding contract; and
• Will comply with all applicable laws and regulations.
• Are at least 16 years old, or the minimum age of digital consent in your country of residence, to use the Services.

We may revise these Terms periodically. Updates will be posted on the Website, and continued use after publication constitutes acceptance.

4. Accounts and Registration

4.1 To use the Services, you may create only one account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4.2 You must immediately notify us at hello@japply.org of any unauthorized use or security breach.

4.3 We reserve the right to suspend or terminate accounts at our discretion, including in cases of fraud, abuse, or violation of these Terms.

5. Use of the Platform

You agree not to:

• Use JApply for unlawful, harmful, or malicious purposes;
• Copy, modify, distribute, or reverse-engineer any part of the Platform;
• Upload or transmit misleading, infringing, or malicious content;
• Attempt to gain unauthorized access to our systems or data.

You further acknowledge and agree that:

• Any unlawful, fraudulent, defamatory, discriminatory, or harmful use of the Platform is your sole responsibility.
• JApply SAS and the owner of JApply shall not be held liable for any damages, losses, or claims arising from your misuse of the Platform or any unlawful activities performed through your account.
• In the event of a complaint or legal investigation related to user misconduct, JApply SAS and/or the owner of JApply will fully cooperate with competent authorities, including by providing information permitted or required by law.
• We may suspend or restrict access to users who violate these rules or engage in any activity that jeopardizes the security, integrity, or reputation of the Platform.

6. AI Content Disclaimer

JApply uses advanced Artificial Intelligence (AI) technologies to assist you in generating CVs, cover letters, and other professional materials (“AI Content”).

While we strive to deliver accurate, helpful, and high-quality outputs, AI-generated text may occasionally contain errors, incomplete information, or wording that does not fully reflect your intent or profile.

For this reason, we kindly remind users to carefully review, verify, and edit all AI-generated content before using or sharing it. You remain responsible for the final content you choose to submit or communicate to third parties.

By using JApply, you acknowledge that:

• AI Content is provided as an assistive tool, not as a professional or legal service.
• JApply SAS and the owner of JApply cannot be held responsible for the accuracy, interpretation, or consequences of any AI-generated output.
• We continuously improve our models and welcome feedback to enhance their reliability and quality.
• AI outputs are generated automatically and may reflect limitations of the underlying models or available data.
• Although our AI strives for fairness and neutrality, outputs may occasionally reflect societal biases present in training data. We encourage users to review and adapt all generated content responsibly.

7. Intellectual Property

7.1 All intellectual property in the Platform — including software, source code, database (structure and content), UI/UX design, graphics, logos, and documentation — is owned personally by LOGOSU–TEKO Ekoue Max Aristide Patrice, and licensed to JApply SAS solely for the purpose of providing the Services.

7.2 All user-generated materials (e.g., uploaded CVs, cover letters, photos, personal data) remain your property. By uploading them, you grant JApply SAS a limited, non-exclusive, worldwide, royalty-free license to store, process, and display them as necessary to operate the Services. Users may export or delete their generated materials at any time from their account, subject to technical limitations and applicable data-retention obligations.

7.3 You represent and warrant that your content does not infringe third-party rights.

Nothing in these Terms transfers ownership of intellectual property from the owner to JApply SAS or to users.

8. Payments, Subscriptions, and Refunds

8.1 JApply offers both Free and Paid subscription plans. Paid subscriptions grant access to advanced features as described on our Pricing page.

8.2 Payments are accepted in FCFA, EUR, USD, GHS, and Bitcoin through available payment partners.

8.3 All fees are clearly indicated before purchase. Users can request a refund from their dashboard, with respect to our refund policy.

8.4 Subscriptions may renew automatically depending on the payment processor’s configuration; users can cancel renewal at any time in their account settings.

8.5 We reserve the right to adjust pricing or billing methods with reasonable notice on the website.

8.6 All payments are processed securely via third-party payment processors. We do not store users’ complete payment card details.

9. Data Protection & Privacy

9.1 We collect and store personal data including your name, email, photo, background information, user story, and generated CV for the purpose of providing our Services.

9.2 We process this data securely and do not sell it to third parties. Data may be hosted on servers outside Burkina-Faso but under adequate security standards.

10. Termination

10.1 You may delete your account at any time.

10.2 We may suspend or terminate your access without notice if you violate these Terms or engage in abusive, fraudulent, or harmful activity.

10.3 Termination does not affect accrued payment obligations or provisions that by their nature should survive termination (e.g., liability limitations, intellectual property).

11. Limitation of Liability

We work hard to ensure that JApply remains reliable, secure, and useful for all users. However, like any online service, certain issues (technical failures, network interruptions, or third-party errors) may occasionally occur.

To the fullest extent permitted by law:

• The Platform and its Services are provided on an “as available” basis. We make no absolute guarantee of uninterrupted access, but we commit to addressing problems promptly and transparently.
• JApply SAS and the owner of JApply shall not be liable for any indirect, incidental, or consequential damages such as loss of opportunity, income, or data, resulting from the use or inability to use the Services.
• If any liability is established, it shall be limited to the total amount you have paid to JApply SAS for the Services during the twelve (12) months preceding the claim.
• We shall not be held responsible for any delay or failure in performance resulting from causes beyond our reasonable control, including internet disruptions or acts of government.

Our intention is always to build trust and deliver value — these provisions exist only to maintain a fair and balanced framework for all parties.

12. Modifications and Availability

We continuously strive to improve JApply and may introduce updates, enhancements, or new features from time to time.
Occasionally, we may need to temporarily suspend access to part or all of the Platform to perform maintenance, upgrades, or security checks. We will make reasonable efforts to provide prior notice on the Website when such interruptions are planned.

If we ever decide to permanently discontinue a service or major feature, we will inform users in advance through an announcement on the Website and/or by email to registered users.

In the event we permanently discontinue the Service, users will be granted a minimum of 30 days to export their data and generated materials before access is disabled.

While we aim to ensure the Platform remains accessible and reliable, certain technical or operational events may cause temporary unavailability. In such cases, we will work diligently to restore normal service as quickly as possible.

Material changes to these Terms will be notified to users by email or in-app message at least 30 days before they take effect, except where immediate implementation is required for legal, security, or operational reasons.

13. Third-Party Links and Services

The Platform may contain links or integrations with third-party websites, applications, or services that are not operated by JApply. These are provided only for your convenience and may include payment processors, content partners, or external resources.

We take care to collaborate only with reputable partners. However, since we do not control these external websites or their content, we encourage you to review their own Terms & Conditions and Privacy Policies before using them.

JApply SAS and the owner of JApply are not responsible for the accuracy, security, or availability of third-party services, but we welcome feedback from users if any linked partner causes concern, so we can take appropriate action.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Burkina-Faso. Any disputes arising out of or relating to these Terms shall be resolved exclusively by the competent courts of Ouagadougou, Burkina-Faso.

For users residing outside Burkina Faso, mandatory consumer-protection laws of their country of residence shall apply where required by applicable law.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices posted on the Website, constitute the entire agreement between you and JApply SAS regarding the use of the Platform.
